Technician Application Terms

By completing NBI’s online “Technician Questionnaire” and thereby applying to join the NBI Locator Program, you, as a “Technician”, agree to the following terms and conditions of your participation in the Locator Program:

The NBI Locator Program

1)       Nationwide Blind Installation, Inc., of 4 Meadowbrook Rd. Wilmington, MA 01887 (“NBI”) operates an online “Locator Program” in which:

a)       Technicians seeking work measuring and installing window coverings (”Blinds”), provide NBI with details including their work experience, labor rates, and the distance from their home or business location they are willing to travel to provide the stated services.

b)      NBI selects those Technicians who, in NBI’s absolute discretion, are best qualified to be included in the Locator Program.

c)       NBI licenses to Internet-based retailers (“Internet Sites”) of Blinds a software inquiry system that they can make part of their web site.  This inquiry system shall take the form of a zip code-based “Locator Box”.

d)      Consumers seeking a local contractor to measure and/or install Blinds can use the Locator Box to inquire if there is a Technician in the Locator Program available in their area and, if so, to view information such as the Technician's experience and labor rates.

e)       The consumer may then request the Technician’s contact information be sent to them by e-mail.  Upon the receipt of such request, NBI will also send an e-mail to the selected Technician with any project-related details provided by the consumer (“Job Notice”).  Following the distribution the Job Notice, the consumer shall be deemed to be a “Client” of the selected Technician.

f)        The Client then deals directly with the selected Technician and, if they mutually agree, the Technician may then work for the Client and the Client will pay the Technician directly.

Workmanship Guarantees

2)       The Technician will honor the following “Workmanship Guarantees” offered to al Clients (where “You” is the Client):

Technicians accepted into the NBI Locator program have agreed to honor these guarantees, provided:

*    You tell the Technician that you were referred by NBI, and provide the Job # contained in NBI’s e-mail, and

*    Your window coverings are ordered from the Internet site through which you originally contacted the Technician, and

*    Any installation is done by the same Technician that did the measuring, and

*    You, the customer, are on site at the time the services are performed, and

*    The services are paid for in full on the day that the work (measuring, or installation) is done.

Measuring

The Technician guarantees that if (s)he incorrectly measures the width and height of window treatments, the Technician will repair or replace the window treatments free of charge and to your reasonable satisfaction, provided:

*    A completed measurement form (a link to download the form is in your original e-mail), signed by the Technician, is on site at the time of installation, and

*    Your window coverings are ordered to the exact product specifications recorded by the Technician.

Installation

The Technician also guarantees the quality of installation workmanship, and will correct any installation problems free of charge for 12 months, provided you notify NBI of job completion using our online Management System (a link to is in your original e-mail), and complete a simple online Customer Survey within 7 days of installation.

 

Job Progress Reporting and Referral Fees

3)       If the Client has not contacted the Technician within 24 hours of the Technician receiving an e-mail Job Notice, the Technician will use reasonable efforts to contact the Client, define their requirements, and update NBI’s online Job Management System.

4)       The Technician will use NBI’s online Job Management System to promptly report the changes to the status of all Jobs, using reasonable care to ensure that the information provided is correct.

5)       The Technician shall send a “Referral Fee” equal to $5 per installed Blind, to NBI within 30 days of their payment by the Client.

Etiquette

6)       The Technician will conform to the following “Code of Contractor Etiquette”:

a)       Arrive as scheduled and, if delayed, promptly notify the Client and arrange a new appointment.

b)      Agree on any extra charges with the Client before work is started.

c)       Only start work that the Technician is qualified to perform and that can be completed with the highest quality for the quoted price.

d)      Behave professionally while in the Client's home (no smoking, eating, etc.)

e)       Not use the Client's property (i.e., telephone, computer, etc.) for personal use.

f)        Have a neat appearance and be conscious of working with clean hands.

g)      Not track debris into the Client's home, and clean up any mess caused by the work.

h)       Consolidate and place trash where the Client prefers (curbside, garage, etc.)

i)         Follow and abide by all safety regulations, regarding those relating to cords and strangulation, set forth by the U.S. Consumer Product Safety Commission and any similar state laws.

j)         Promptly notify NBI of any Client complaints.

The Rules

7)       The Technician may leave the Locator Program at any time and for any reason simply by notifying NBI in writing, or via e-mail, of their wish to do so.  However, while a member of the Locator Program, the Technician agrees to comply with the rules and procedures of the Locator Program.

8)       The Technician represents and warrants to NBI that:

a)       The Technician is a contractor experienced in measuring and installing Blinds.

b)      All the information provided by the Technician to NBI via NBI’s online “Technician Questionnaire” is accurate to the best of his/her knowledge, and the Technician will promptly notify NBI of any changes.

c)       Any of the Technician’s liability insurance is current and will be maintained in full force and effect.  The Technician shall carry all other insurance mandated by law.

d)      The Technician will comply with all local, state and federal laws, including licensing and tax reporting.

9)       The Technician will not encourage or enable any Client introduced to the Technician through the Locator Program to purchase Blinds from any source other than the Internet Site through which the Client originally contacted the Technician within 12 months of the original Work Request.

10)   The Technician will keep confidential all information about the Locator Program and its Clients, other than is needed to complete the work for the Clients and conform to these terms and conditions.

11)   All services provided by the Technician for Clients are to be performed free from all liens or claims whatsoever.

12)   NBI and the Technician are independent contractors and that nothing contained herein shall place them in any other relationship (i.e. as a partner or agent).  Except as expressly provided herein, neither NBI nor the Technician shall have the power to make any commitments for the other.

13)   NBI’s sole responsibility with the Locator Program is to accurately provide to Clients and Technicians the information provided to it by its member Technicians and Clients.  NBI makes no other warranty whatsoever with respect to the abilities and background of any Technician, the quality of any services that may be performed by a Technician, or of any Client's ability to pay for Blinds and for services provided by a Technician.

14)   NBI and the Internet Sites shall have no responsibility to the Technician other than to operate the Locator Program in a reasonably business like manner.

15)   The Technician agrees to indemnify NBI and the Internet Sites from any suits, claims, or costs incurred by them (or their agents and employees) arising from action (or inaction) by the Technician.

16)   NBI shall not be liable to any Technician for any damages in connection with the Locator Program.

General

17)   These terms may only be amended by an authorized representative of  NBI.

18)   These terms shall be construed and enforced in accordance with the laws of the Commonwealth of Massachusetts.

19)   NBI may change these terms at any time by e-mail or fax notification to the Technician and, unless the Technician notifies NBI otherwise within 7 days, it will be assumed that Technician had agreed to the changes.
